Terms of engagement
These terms apply to estimate requests and paid engagements with Clearpoint Application Audit.
Acceptance
By submitting an estimate request or confirming a written engagement note, you agree to these terms. If you act on behalf of a company or organization, you confirm authority to bind that entity.
Services
We provide independent financial review of application packets as described on this site. Our findings memoranda are advisory. They do not constitute approval by any lender, funder, or regulator, and they are not a substitute for legal, tax, or valuation advice.
Client responsibilities
You remain responsible for the accuracy of materials you supply and for decisions about whether and how to submit an application. You must not present our review as a guarantee of funding or facility approval.
Intellectual property
You retain ownership of your application materials. Clearpoint retains ownership of our templates, methodologies, and the findings memorandum as a work product licensed to you for internal use related to the reviewed application. You may not republish our memorandum as marketing material without written consent.
Fees and payment
Fees are confirmed in the engagement note. Deposits and refunds follow the policy at /refund/. Late payment may pause delivery of findings.
Limitation of liability
To the fullest extent permitted under the laws of Taiwan, Clearpoint Application Audit’s aggregate liability arising from an engagement is limited to the fees paid for that engagement. We are not liable for consequential losses, lost funding, or decisions made by third-party institutions.
Governing law
These terms are governed by the laws of Taiwan (Republic of China). Courts located in Taiwan have exclusive jurisdiction over disputes arising from these terms or related engagements, subject to any mandatory consumer protections that apply.
Changes
We may update these terms by posting a revised version on this page. Confirmed engagement notes continue under the version referenced in that note unless both parties agree otherwise.
